The FDA MOCRA Registration for Cosmetic Products Intended for the American Market

As part of the MOCRA regulation, the FDA announces the opening of the online platform for reporting adverse events for cosmetic products sold in the American market. Within the platform, cosmetic manufacturers can report adverse events related to their own cosmetic products, or consult adverse events that occurred in the American market concerning cosmetic products imported into the United States by other cosmetic manufacturers.

Starting July 1, 2024, it becomes mandatory to register cosmetic products with the FDA for the United States.

The application of the MOCRA regulation requires that, under certain conditions, manufacturers and exporters of cosmetic products must register with the FDA both the cosmetic products intended for export to the United States and the manufacturing company, in a manner very similar to what is required for importing food products or dietary supplements into America.

In a move that could prove to be a relief for some cosmetic manufacturers, on November 8, the Food and Drug Administration (FDA) announced that the new registration requirements for cosmetic products and facilities — part of the MOCRA regulation on the Modernization of Cosmetic Regulation — will not be enforced until July 1, 2024, giving cosmetic product manufacturers six more months to comply with the new American regulation regarding the distribution of cosmetics in the American market.

The opening date of the FDA portal to register companies and cosmetic products for importation into America was initially scheduled for October 29. At the time of the FDA's announcement, our opinion was that the opening date of the portal would be postponed because the timeframe was too tight.

However, it seems that the FDA will be able to meet the October 29 opening date of the MOCRA portal. Screenshots of the portal and the entire procedure for registering manufacturing companies and American importers of cosmetic products, as well as the ingredients of the products to be imported, have been published. This publication was part of the period open for public comments before promulgating rules and regulations, a typical procedure for all federal agencies such as the FDA. This means the portal is already ready, and it's just a matter of waiting for comments before officially opening the MOCRA registration for importing cosmetic products into America.
