Good evening Dr. Miranda, I hope you are doing well.
I am reaching out to ask for your help regarding an issue we encountered during the customs clearance process with U.S. Customs recently to import a container of goods at the Norfolk port. Here are the details.
While preparing the U.S. import customs documentation, THE ITALIAN CARRIER made a mistake by inserting the email of the customs broker at the Norfolk port into the bill of lading, and thus the American correspondent OF THE ITALIAN CARRIER sent all the documents (including the ISF document) to the wrong email address, with a non-existent domain. No employee OF THE ITALIAN CARRIER noticed the mistake, and the customs broker at the Norfolk port never received the documents by email.
The container arrived at the port without the ISF, well after the deadline to present it to U.S. Customs. Now, submitting the ISF after the deadline risks a fine of $5,000 to $10,000, and no American customs broker at the Norfolk port is willing to take on this responsibility.
FROM THE ITALIAN CARRIER, I have not received any concrete response at this time. They only say that they can't do anything quickly without the Power of Attorney. Tomorrow, we will be on the phone with THE ITALIAN CARRIER all day to try to resolve the issue that has arisen with U.S. Customs. The customs brokers at the Norfolk port refuse to file the ISF even if THE ITALIAN CARRIER agreed to cover the fine and they suggest the following:
“For our broker, customs may allow you to file a late ISF online and not via AMS (the U.S. Customs online system for managing imports) and you don't need a POA to do it. The shipper or THE ITALIAN CARRIER can file the ISF retroactively. “
However, now THE ITALIAN CARRIER is asking us to fill out the attached file to authorize them to proceed with the late ISF filing. The problem is that with this document, we also have to agree to pay all the penalties arising from this error, whereas it should be THE ITALIAN CARRIER who agrees to pay the penalties, considering it was their mistake.
